Court sacks former senate president,David Mark, orders rerun

The election of Senator David Mark as the senator representing Benue South senatorial in the 8th senate district has been nullified by a Court of Appeal sitting in Makurdi, Benue State with a rerun expected to be held within 90 days.

The former senate president’s election was challenged by the candidate of the All Progressives Congress, Donaldd Onjeh, on account of electoral malpractices.

Mark’s election had earlier been upheld by the election petition tribunal in Benue State. But the Court of Appeal ruled that the Independent National Electoral Commission (INEC) in declaring him as the winner of the polls.

    Cancellation and rerun are not punishment for electoral malpractices. The Electoral Act stipulates punishment for the crimes. Tribunal members should learn to give complete judgments. We should ban politicians who rig elections and bar their parties from presenting candidates for affected elections for some time.

      I agree with you but the tribunal is not empowered to adjudicate on criminal proceedings. Also before a court can try a contestant or anyone for that matter on issues of election fraud, there must be a criminal investigation and indictment before such a person could be prosecuted. I think our electoral laws have to be reviewed with the aim of strengthening them.
