Court refuses Obanikoro’s application to restrain media house

Justice Atinuke Ipaye of a Lagos High Court sitting in Ikeja has refused the request of former Minister of State for Defence, Sen. Musiliu Obanikoro for an order of injunction against media outfits.

Obanikoro filed a libel suit against online news publication, Sahara Reporters and the publisher, Mr. Omoyele Sowore, Premium Times and the Punch Newspapers.

In his suit, he claimed that the defendants had published damaging material, which made him suffer various political, personal and personal losses.‎ Ruling on his application yesterday, the presiding judge said Obanikoro’s application for restraining order of injunction is lacking in merit.‎

“There is nothing before the court that shows the applicant will suffer more harm if the injunction is not granted. It is an error to seek to restrain a publisher of an article on the grounds of libel if there is no proof before the court that such material is libelous.
