Court nullifies Ogboru’s gubernatorial primary poll, rules in Victor Ochei’s favour

A federal High Court, Asaba, Delta State has nullified the September 30, 2018 of 30th September 2018 All Progressives Congress (APC) gubernatorial primary which produced Great Ogboru as the party’s candidate for the 2019 governorship election.

The nullification followed a suit filed by Victor Ochei, who was dis- satisfied with the conduct of the primaries and had approached the court seeking cancellation of the exercise.

Ochei had prayed the court to invalidate the results of the primary and declare that the list of delegates was not the one envisaged by the consent judgement, among others.

He also said the contestants did not get any advanced list of delegates prior to the primary election.

Delivering judgment, Justice Nnamdi Dimgba ordered the cancellation of the primary that produced Ogboru, saying four of the five reliefs sought by the plaintiff succeeded, while relief one was not granted.

In arriving at the ruling, Justice Dimgba said the Federal High Court has one jurisdiction and as such, could not be seen to give contrary judgements.

Besides, a chieftain of APC in Delta State, Olorogun O’tega Emerhor, has described the purported affirmation by a Warri Federal High Court of Senator Ovie Omo-Agege’s candidacy in the 2019 elections in a judgement delivered on April 2, 2019 as a ruse.

He stated this in a statement issued yesterday by his Media Aide, Godspower Itietie, while reacting to reports of a purported court affirmation being celebrated by Omo-Agege’s supporters.

He insisted that Omo-Agege’s candidacy had on March 18, 2019 been annulled in a judgement at an Asaba Federal High Court alongside the Jones Erue executive from the governorship, National Assembly and the state House of Assembly candidates.

Meanwhile, a Federal High Court in Birnin Kebbi, has adjourned Senator Bala Na’Allah and Sule Sami’s case in which he (Sami) challenged the validity of Na’Allah’s candidacy for the October 2018 Kebbi South Senatorial district primary election to April 5.

Justice Bassey Onu adjourned the matter after oral application was made by the first and third respondents, Sanusi Samaila and Ifeoluwa Adeyemo and which the second respondent, Afraimu Jingi, supported the submission seeking adjournment of the matter by one week.
