When the case came up for hearing yesterday, counsel representing the former governor, Mr. J. A. Dauda SAN told the court that by law Governor Samuel Ortom has no powers to set up Judicial Commission of Inquiry or Administrative Commission of Inquiry to probe his predecessor, saying such power is only vested with the state House of Assembly.

Mr. Dauda SAN also argued that the commission of inquiry by law was based on the 1963 constitution enacted by our colonial masters, stating that with the amendment of the 1999 constitution,
