You cannot arrest bank officials on lawful duties, court tells Police

Abia High Court, Nkwoagu Isuochi, has said that no court of law counter-signs document with the Police and that it is unlawful for the Police to arrest any bank official who is carrying out his or her lawful duties.

The trial judge, Mr. Justice Benson Anya, also declared that no bank official is bound to obey the unlawful directive of any public officer by whatever name is called.


He said if a bank is in doubt of what amounts to an order of the court, the bank must be given a reasonable opportunity to approach the court to authenticate and confirm the status of the said directive.

Justice Anya made these declarations and ruling while hearing suit marked HUM/3M/2022 between Valentine Ifeanyichukwu Odiniru and four others.
 
The others are Ecobank Nigeria Plc., Mr Onyekachi, who is operations manager, Ecobank, Faulks Road Branch, Supol Iboro, D.C.O Central Police Station Aba and Commissioner of Police, Abia State, who are the first, second, third and fourth respondents in the suit.
