The APGA candidate, Dr. Alex Otti, is challenging the declaration as winner of his Peoples Democratic Party (PDP) opponent, Governor Okezie Ikpeazu, and joined PDP and the Independent National Electoral Commission (INEC) as respondents in his petition now being heard.

The chairman, Justice Usman Bwala, struck out the application based on paragraph 18 of the 1st schedule of the electoral act. Kalu and his colleague, Akeredu Rotimi (SAN), had submitted that the electoral act permits an abridged seven days within which to put up their case and present witnesses.
