Police urged to comply with court order

araseThe Nigerian police has been urged to comply with the order of a Lagos High Court presided over by Justice O.A Adefope- Okojie in a suit filed by Esther Okoegbu over parcel of land situate at No 82, Obafemi Awolowo way, Ikeja.

The claimant had through his counsel, David Ejiaku in a suit delineated 1D/3211/94 got an order of court restraining the defendant from trespassing on the said property.

Justice Adefope-Okojie had on February 14, 2012 ruled against the defendant, Mr. Ayeni Akintola and associates for trespassing on claimant’s piece or parcel of land situate at No 82, Obafemi Awolowo way, Ikeja, Lagos state and delineated on Plan No ISO/LA393/85 OF 22nd April, 1985.

Counsel to the claimant in a petition the police over illegal destruction and alleged threat to workers lives on the property and constant harassment by men the police.

Part of petition reads that: “On the 14th day of Feb, 2014, we had applied and gotten a warrant of possession from court to execute a judgment in suit No 1D/3211/94 in our client’s favour, subsequently the office of the Deputy Sheriff, Ikeja High Court, Lagos State, did levy the execution and gave us physical possession on the 28th of April, 2015.

“Following the Sheriff’s execution, our valued client instructed that a fence be put up to delineate the properties in dispute along the lines demarcated by the court order in our Survey Plan No /SO/LA/393/85.

“After the erection of the fence, to our dismay, the fence was pulled down at night by thugs hired by the owners of No 84, Awolowo way, Ikeja, Lagos with utmost disrespect to the court execution order boldly written on the walls of the property. However, our biggest threat and fear is that these people are using men of the Nigerian Police to carry out this illegal criminal activities, daring us to come anywhere near the property.

“Hence, we have come to your elevated office to redress this situation as a dangerous precedence for the Police to be engaged in such nefarious activities”.
