NAFDAC arraigns man for allegedly selling unwholesome food products

THE National Agency for Food Drug Administration and Control (NAFDAC) has arraigned a businessman, Ezeudu Emmanuel before a Federal High Court, Lagos for selling food products without registration.

The accused was arraigned before Justice Rita Ofili-Ajumogobia on a ten count charge bordering on the offence.

After the charges were read to him, he pleaded not guilty. Consequently, the prosecuting counsel, Umaru Shamaki, prayed the court to remand him in Ikoyi Prison pending the hearing of his bail application.

But the defence counsel said the accused has been in administrative bail and reported to NAFDAC for the purposes of the arraignment. “I am appealing that the accused re remandeed with NAFDAC in the absence of a written bail application which he is entitled to”, he prayed the court, in the event his oral bail application fails.

But Shamaki said: “We dont have detention facility. We request as a result that the accused be kept in Ikoyi Prison pending trial”. He admitted that the accused has not done anything suggesting that he would not abide by the terms of his administrative bail.

Consequently, the trial judge granted the accuse bail based on the administrative bail, consequent upon his submission of the terms of the administrative bail conditions before the court within 24 hours and adjourned to July 7.
According to the prosecutor, the accused on or about April 27, 2015 did sell food products without registration . The products include Pine White Ground Pepper, Summerfield whole Kernel Sweet Corn, Bama Mayonnaise, Summerfield Baked Beans, Sweet Chili Chiken Sauce, Real Value Mayonnaise and Superior Light Soy Sauce and unlabelled sauce. He said the action is contrary to section one of the Food, Drugs and related products Act Cap F33 LFN 2004 and punihsable under section 6(1)(a) of the same Act.

He was also accused of unlawful packaging, labelling, being in possession of unwholesome processed food products asa well as distributing such products.
